The main difference is that criminal organizations use their own enforcement tactics. Obviously, they cannot rely on courts or legislatures to protect them.
Wainwright is dissatisfied with government's losing effort on the "War on Drugs". Counternarcotic efforts are notorious for overlooking long-term global problems. One thing that seems to be keeping dangerous cartels from thriving is allowing businesses to sell drugs within the law (like in Colorado).
